These Terms & Conditions apply to purchases made from Rosie’s Kiwi Pantry through our website, by email, through an order form, or through any other ordering method we make available.

Please read these terms before placing an order. By placing an order with Rosie’s Kiwi Pantry, you agree to these Terms & Conditions.

Nothing in these terms affects your statutory rights as a consumer.

1. About Rosie’s Kiwi Pantry

Rosie’s Kiwi Pantry is a food and lifestyle business operating in United Kingdom.

References in these terms to “Rosie’s Kiwi Pantry”, “Rosie’s”, “we”, “us” or “our” mean the person or business operating Rosie’s Kiwi Pantry.

Our website is hosted using Shopify, which provides the ecommerce platform through which certain orders and payments may be processed.

2. Our products and services

Rosie’s Kiwi Pantry is a growing food and lifestyle business inspired by New Zealand.

Products and services offered from time to time may include:

  • freshly baked sweet and savoury goods;
  • Weekend Kiwi Boxes and other mixed food boxes;
  • cakes, biscuits, slices, confectionery and similar baked goods;
  • pies and other savoury products where available;
  • gift boxes and seasonal collections;
  • catering and custom orders;
  • food gifts and hampers;
  • pantry products;
  • merchandise, crafts, homewares and other non-food goods;
  • products made by selected New Zealand or New Zealand-inspired makers and suppliers; and
  • other products or services introduced in the future.

Not all of these products or services will be available at all times.

The products shown on our website at the time you order are the products currently available for purchase.

3. Handmade products and natural variation

Many of our products are handmade in small batches.

For this reason, appearance, size, colour, decoration, shape and finish may vary slightly from photographs shown online or from previous orders.

These natural variations are part of the handmade nature of the product and will not normally be considered a fault.

We aim to represent our products as accurately as reasonably possible, but colours may also appear differently depending on your screen or device.

4. Availability

All orders are subject to availability and production capacity.

We may limit the number of orders or individual products available for a particular collection date, weekend, season or promotion.

Placing an item in your basket does not reserve it. An order is only secured once checkout has been completed and your order has been accepted.

If we are unable to fulfil an order after payment has been taken, we will contact you and offer an appropriate alternative, credit or refund.

5. Weekend Kiwi Boxes

Where Weekend Kiwi Boxes are offered, customers may be able to select:

  • a box size;
  • the quantities of individual flavours;
  • a collection day; and
  • other options displayed on the product page.

Customers are responsible for reviewing their selections before completing checkout.

Any limits on the number of pieces of a particular flavour are part of the product configuration and will be displayed before purchase.

Availability of individual flavours may change from time to time.

6. Orders

When you place an order, you are making an offer to purchase the products in your basket.

You will normally receive an order confirmation by email.

A contract between you and Rosie’s Kiwi Pantry is formed when we accept your order.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

  • a product is unavailable;
  • there has been an obvious pricing or website error;
  • payment has not been authorised;
  • we cannot safely or reasonably fulfil the order;
  • an order appears fraudulent or abusive; or
  • circumstances outside our reasonable control prevent fulfilment.

If we cancel an order after payment has been taken, you will receive an appropriate refund.

Online sellers must provide customers with key information about the product, price, payment, delivery or collection arrangements and cancellation rights before the order is placed.

7. Prices and payment

Prices are shown in pounds sterling (£) unless otherwise stated.

The price payable is the price displayed at checkout at the time you place your order.

Payment must be made using one of the payment methods made available at checkout.

We may change our prices at any time, but changes will not affect orders already accepted.

Where an obvious pricing error has occurred, we may contact you before accepting or fulfilling the order.

8. Collection

Many Rosie’s Kiwi Pantry products are currently offered for collection.

Available collection dates, times and general collection information will be displayed during the ordering process.

The full collection address and any relevant instructions may be supplied following confirmation of your order.

Please arrive during your selected or agreed collection window.

If you expect to be late, please contact us as soon as possible using the contact details provided with your order.

We may request your order number, name or other reasonable proof of purchase when an order is collected.

Another person may collect your order on your behalf where they can provide sufficient order details.

9. Missed collections

Our food products are often prepared specifically for a particular collection date.

If you fail to collect your order during the agreed collection period and do not contact us, we cannot guarantee that the products can be stored or made available at a later date.

Where products are perishable and can no longer safely or reasonably be supplied following a missed collection, a refund may not be available.

We will always try to resolve genuine collection difficulties reasonably where possible.

10. Delivery

Delivery may be introduced for selected products in the future.

Where delivery is available, the relevant:

  • delivery area;
  • delivery charge;
  • estimated timescale;
  • courier or delivery method; and
  • any product-specific restrictions

will be displayed before purchase.

Some products may remain collection-only because they are fresh, fragile, temperature-sensitive or otherwise unsuitable for transport.

Where a third-party courier is used, we remain responsible for complying with applicable consumer law, but customers must provide accurate delivery details.

Any special delivery conditions applying to a particular product will be shown before checkout.

11. Custom, bespoke and catering orders

We may accept catering, celebration, event or bespoke orders separately from our standard online range.

The specification, price, quantity, payment terms, collection or delivery arrangements and deadline for a custom order may be agreed separately in writing.

A deposit or advance payment may be required.

Because personalised or custom-made goods can fall outside the normal change-of-mind cancellation rights, bespoke orders may be subject to different cancellation terms.

Any specific terms agreed for a bespoke order will take priority over conflicting general terms on this page.

12. Changes to an order

If you need to change an order, please contact us as soon as possible.

Changes should also be requested by 8:00pm on the Thursday immediately before that weekend’s collection. After that point, amendments will only be possible at our discretion.

We will try to accommodate reasonable changes, but we cannot guarantee that amendments will be possible once ingredients have been purchased, production has begun or capacity has been allocated.

Additional charges may apply where a requested change increases the cost of an order.

13. Cancellations and change-of-mind refunds

Your cancellation rights depend on the type of product you buy.

Fresh and perishable food

Many of our baked goods and food products are fresh or perishable.

UK consumer rules provide exceptions to the usual change-of-mind cancellation right for goods that deteriorate or expire rapidly.

Accordingly, once production has begun, or where an order consists of fresh or perishable goods prepared for a particular collection or delivery date, we may be unable to accept a change-of-mind cancellation.

Personalised or custom-made products

Products made to your specification or clearly personalised may also be exempt from normal change-of-mind cancellation rights.

Non-perishable goods

If we later sell non-perishable goods that are not personalised or otherwise exempt, your normal statutory distance-selling cancellation rights will apply where relevant.

Nothing in this section limits your rights where goods are faulty, damaged, unsafe or not as described.

Cancellations for weekend collection orders

Orders for Saturday or Sunday collection may be cancelled up to 8:00pm on the Thursday immediately before that weekend’s collection for a full refund.

After this deadline, ingredients may already have been purchased and preparation or production may have begun, so we may be unable to offer a refund where you simply change your mind.

Requests to amend an order should also be made by 8:00pm on the Thursday immediately before that weekend’s collection. Changes requested after this deadline will be accommodated where possible, but cannot be guaranteed.

This cancellation policy does not affect your statutory rights if your order is faulty, unsafe, incorrect or not as described.

14. Faulty, incorrect or damaged orders

We take care when preparing and packing orders.

If your order is:

  • materially different from what you ordered;
  • damaged before collection or delivery;
  • unsafe;
  • of unsatisfactory quality; or
  • otherwise not as described,

please contact us as soon as reasonably possible and provide your order details.

Photographs may be requested where appropriate so we can understand what has happened.

Depending on the circumstances and your legal rights, we may offer a replacement, refund, partial refund or another appropriate remedy.

We do not exclude or restrict your statutory consumer rights. GOV.UK specifically states that businesses cannot remove customers’ rights in relation to faulty or misdescribed goods.

15. Storage and care after collection or delivery

Customers are responsible for following any storage, refrigeration, reheating, consumption or use instructions provided with a product.

Fresh products should be consumed within the recommended period.

Once an order has been collected or successfully delivered, we cannot normally accept responsibility for deterioration or damage caused by:

  • incorrect storage;
  • excessive heat;
  • failure to refrigerate where required;
  • inappropriate reheating;
  • mishandling;
  • contamination after collection; or
  • consumption after the recommended period.

This does not affect your rights where the product was already faulty or unsafe when supplied.

16. Ingredients and allergens

Food allergen information will be made available before purchase where required and again when the food is supplied.

UK food-business guidance requires allergen information to be available before the purchase is completed and when the food is delivered or otherwise supplied.

Our products may be prepared in an environment where multiple allergens are handled.

Full allergen information is available on our Allergen Information page and, where appropriate, on individual product pages.

Recipes and branded ingredients can change, so customers with allergies or dietary requirements should review the current allergen information each time they order.

If you have a serious allergy, please contact us before placing an order so that we can explain the preparation environment and available information.

Unless expressly confirmed by us, no product should be assumed to be allergen-free.

17. Ingredient and product substitutions

Occasionally, an ingredient, decoration, flavour, packaging component or other item may become unavailable.

Where necessary, we may make a reasonable substitution of equivalent or better quality, provided it does not materially change the product or introduce an undeclared allergen.

Where a proposed substitution would materially affect your order, we will try to contact you before fulfilment.

18. Products supplied by other makers

Rosie’s Kiwi Pantry may in future offer products produced by independent makers, craftspeople or suppliers.

Where this occurs, the identity of the maker or brand may be shown on the relevant product listing.

Some products may have their own care instructions, warranties, restrictions or product-specific terms.

Your statutory rights when purchasing through Rosie’s Kiwi Pantry will not be reduced by the fact that an item was made by a third party.

If we later operate any marketplace or direct-seller model where the customer contracts directly with another seller, this will be made clear before purchase and separate terms may apply.

19. Promotions and discount codes

From time to time, we may offer promotional codes, subscriber offers or other discounts.

Unless otherwise stated:

  • promotional codes have no cash value;
  • they cannot be applied retrospectively;
  • only one promotional code may be used per order;
  • codes may be restricted to specific customers, products, dates or order values;
  • promotions may be withdrawn or changed before redemption; and
  • we may refuse use of a promotion where we reasonably believe there has been fraud, misuse or an attempt to circumvent the promotion rules.

Huffkins uses a similar structure for voucher restrictions and campaign-specific conditions, including one-use restrictions and the ability to reject fraudulent use.

Subscriber welcome offer

Where the WELCOME1 subscriber offer is available:

  • it gives the stated discount off an eligible order;
  • it is available only to eligible email subscribers;
  • it is limited to one redemption per customer;
  • it cannot be exchanged for cash; and
  • it cannot be combined with another discount unless we expressly allow this.

Unsubscribing and later resubscribing does not create a new entitlement where the same customer has already redeemed the offer.

20. Gift messages

Where we provide a gift-message or order-note facility, customers are responsible for the content they submit.

We reserve the right not to reproduce content that is unlawful, abusive, discriminatory, threatening or otherwise inappropriate.

Minor formatting changes may be made where necessary to fit packaging or printed materials.

21. Gift cards and vouchers

If gift cards or vouchers are introduced in the future, their value, expiry date, redemption method and any product restrictions will be stated at the time of purchase.

Unless otherwise required by law, gift cards and vouchers:

  • cannot be exchanged for cash;
  • cannot be applied retrospectively to completed purchases; and
  • may be subject to stated expiry dates.

Any specific gift-card terms will take precedence over this section.

22. Website information

We take reasonable care to keep our website accurate and available.

However, we do not guarantee that:

  • the website will always be uninterrupted or error-free;
  • every item displayed will remain available;
  • descriptions will be entirely free of typographical errors; or
  • photographs will exactly reproduce the appearance of handmade goods.

We may change, suspend or remove website content or features where reasonably necessary.

23. Intellectual property

Unless otherwise stated, the content of this website, including our branding, written content, graphics, photographs, illustrations, logos and design elements, belongs to Rosie’s Kiwi Pantry or is used with permission.

You may not reproduce, distribute, commercially exploit or use our content for another business without permission, except where permitted by law.

24. Customer photographs and social media

We love seeing customers enjoy their orders.

If you tag Rosie’s Kiwi Pantry or send us a photograph, this does not automatically transfer ownership of your photograph to us.

We may ask for permission to repost or use customer-created content for social media, our website or marketing.

Where you expressly grant us permission, you confirm that you have the right to do so.

We will not claim ownership of customer photographs merely because our products appear in them.

25. Reviews and submitted content

If you submit a review, testimonial, comment, photograph or other content directly for publication, you confirm that:

  • it is your own content or you have permission to submit it;
  • it does not infringe another person’s rights; and
  • it is not unlawful or misleading.

Where you expressly submit content for promotional use, you grant us a non-exclusive licence to display and reproduce that content for the purpose for which it was submitted.

26. Privacy

We process personal information in accordance with our Privacy Policy.

This may include information required to process orders, communicate about collection or delivery, provide customer service, prevent fraud and manage email subscriptions.

Our Privacy Policy is available separately on the website.

27. Email marketing

You will only receive marketing emails where we have an appropriate lawful basis to send them.

You may unsubscribe at any time using the unsubscribe link included in our marketing emails.

Unsubscribing from marketing does not prevent us from sending transactional messages that are necessary to fulfil an existing order.

28. Events outside our reasonable control

We will not be responsible for delay or failure caused by circumstances outside our reasonable control.

This might include, for example:

  • serious illness or emergency;
  • power or utility failure;
  • severe weather;
  • transport disruption;
  • supplier failure;
  • equipment breakdown;
  • government restrictions; or
  • other events we could not reasonably have prevented.

Where such an event materially affects an order, we will contact you as soon as reasonably possible and discuss the available options, which may include rescheduling, replacement or refund as appropriate.

29. Our liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so.

In particular, nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses suffered by a consumer acting outside a business context.

Consumer contract terms must be fair, transparent and written in plain language; businesses cannot simply contract out of core responsibilities such as faulty goods or injury.

30. Changes to these terms

We may update these Terms & Conditions from time to time as Rosie’s Kiwi Pantry develops, including when we introduce new products, delivery methods, services or partnerships.

The terms that apply to your order are the terms in force when your order is placed, together with any specific terms shown for that product or service.

31. Governing law

These Terms & Conditions are governed by the laws applicable in the part of the United Kingdom in which Rosie’s Kiwi Pantry operates.

Nothing in these terms affects any mandatory consumer rights you have under applicable law.
